The Customer
The person booking Murphy’s Magic Mirror for their event.
The following contract and its terms comprise an agreement between the Provider and the Customer for the hire of the Mirror.
This written contract sets out the full, intentions of the parties and supersedes any previous written or oral agreements made between the parties.
Terms of the contract
The Customer and The Provider agree that the provider will provide the photobooth services as outlined above. This is a legally binding contract.
This contract represents the entire understanding of the requirements. This looks at the schedule, and payment terms for the photobooth hire on the date and location listed above.
Service Period
Murphy’s Magic Mirror agrees to have the Mirror operational for a minimum of 75% during this period; occasionally, operations may need to be interrupted for maintenance of the mirror.
Payment
The customer agrees to retain the photobooth for the services listed above by signing this contract and paying a non-returnable 20% deposit charge towards the total fee payable. The customer acknowledges that no reservation can be made prior to the signature of this contract and the subsequent payment of the initial service non-refundable deposit charge of a 20% deposit. The remaining balance for the above listed services shall be due in full no later than 21 days prior to the date of the event date as listed above in this agreement. In the unlikely event that payment is not made in full by this deadline, the supplier reserves the right to terminate this contract, retain the initial deposit, and no longer be held liable for providing further services to the clients.
Access, space & power requirements
The Customer will arrange for an appropriate space to be made available for the Magic Mirror at the event venue. A minimum floor area of 3m x 3m is required.
The Customer will provide a mains electricity supply comprising a single 13amp socket located within the space designated by the Customer for the Magic Mirror
Cancellations
Any request to alter the agreed date of the rental of the Mirror must be agreed in advance and every effort from Murphy’s Magic Mirror will be made to try and alter but cannot be guaranteed.
Any change of date is subject to the availability of the Mirror on the alternative date and receipt of a new booking contract.
The clients have the right to cancel this contract at any time up to 100 days prior to the event date. To do so, the clients must send a written cancellation notice via email or certified mail. In this instance, the clients hereby forfeit their initial deposit.
If the customer cancels within 100 days, the customer must agree to pay the full amount for the services listed above.
Reschedule
The customer may reschedule the dates of the event no later than 100 days prior to the wedding date with the written approval of the Photobooth operator. Should the supplier be unable to accommodate the client’s rescheduled date, the customer will not be held responsible for the remaining balance of this contract but will forfeit their initial deposit and payments already made.
COVID-19
In light of the ongoing pandemic, the customer may reschedule the date of their wedding at no extra charge however, if the clients do decide to go ahead and not include Murphy’s Magic Mirror in the restricted numbers as decided by the UK Government at the time of the booking, Murphy’s Magic Mirror will not be able to issue a refund. Both the supplier and the customer need to agree on a new date. Should the supplier be unable to accommodate the customers rescheduled date, the clients will not be held responsible for the remaining balance of this contract but will forfeit their initial deposit and any payments already paid.
Loss or damage to providers equipment
The Customer assumes complete responsibility for any loss of or damage to the Provider’s equipment (other than fair wear and tear) caused by any misuse of the equipment by the Customer, their employees or their guests.
The Customer shall be responsible for any loss of or damage to the Provider’s equipment caused by Theft, Fire, Flood or Accidental Damage.
Therefore, if any damage is made to the Magic Mirror, you as the customer will be billed with the repair.
Health & Safety
Murphy’s Magic Mirror cannot be held responsible of injuries sustained whilst using our photo booths; we reserve the right to finish a booking early if members of the event party are abusive to a member of staff or conflict in any crime against Murphy’s Magic Mirror.
Indemnification
The Customer agrees to, and understands the following:
- a) The Customer will indemnify the Provider against any and all liability related to the Customer’s Event and use of the Provider’s equipment.
- b) The Customer will indemnify the Provider against any and all liability associated with the use of any pictures taken at the Customer’s event by the Magic Mirror or by its operatives, employees or affiliates.
The Customer agrees to, and understands the following:
All persons using the Mirror at the Customer’s Event hereby give to Murphy’s Magic Mirror the right and permission to copyright and to reproduce or otherwise use any photographic portraits or pictures of any Magic Mirror user who may be included in whole or in part, via any or all media now or hereafter known for illustration, art, promotion, advertising, trade, or for any other purpose.
In addition the Customer, hereby releases, discharges and agrees to maintain Murphy’s Magic Mirror free from any liability arising out of the taking of said picture or any subsequent processing or publication thereof including, without limitation, any claims for libel or invasion of privacy.
Miscellaneous terms
If any provision of these terms shall be unlawful, void, or for any reason unenforceable under contract law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof.
This is the entire agreement between the Provider and the Customer relating to the subject matter herein and shall not be modified except as agreed in writing by both parties.
Where the rental includes a photographic printer and for any reason printed photographs cannot be provided on site at the time of the event, the Provider will place the photographs on a web site which the Customer and their guests can access to place an order for prints of any photographs which will then be supplied and delivered by post, free of charge.
The Provider is not responsible for any consequential damages or lost opportunities upon breach of this agreement.
A booking will only be confirmed after the customer has fully read, understood and accepted these terms & Conditions; we reserve the right to change these terms and conditions at any time.
